As per the case of prosecution, the victim aged around 14 years reported to SHO of Police Station Udainagar, District Dewas(M.P.) that she got friendly with Vikas. They used to communicate while working as labourer. On 29.07.2024 around 09.00 in the night, she was alone at home. Vikas came to her home and asked for her Adhar Card. Vikas proposed to take her for labour work, if she had attained the age of 18 years. When she was showing her Adhar Card, Vikas caught hold of her hand and gagged her mouth. Vikas took her to an unknown destination
on his motorcycle. Vikas kept her confined in a rented room for ten days and committed rape on her. Thereafter, Vikas left her at her parental home. On such allegation, PS Udainagar, District Dewas registered FIR at Crime No.327/2024 1 MCRC-46533-2024 NEUTRAL CITATION NO. 2024:MPHC-IND:32311 for offence punishable under Section (s) 87, 137(2), 64(2)(m) of BNS and 5L/6 of POCSO Act against Vikas(applicant). The statement of victim were recorded under Sections 180 and 183 of BNSS. Statement of other witnesses were also recorded. Victim was forwarded for medico-legal examination. No conclusive opinion was given by the medical officer with regard to sexual assault. Applicant Vikas was arrested on 11.08.2024. He is in custody ever since. On completion of
investigation, final report was submitted. Learned Counsel for the applicant, in addition to the grounds mentioned in
the application, submits that the applicant has been falsely implicated in the matter under the pressure of family members of the victim. No offence as alleged is made out against the applicant. Victim had left her parental home at her own wish and she was working as labourer. False allegation of rape is levelled against the applicant to create pressure for marriage with the victim. Learned counsel further submits that the applicant is aged around 19 years. He is a labourer by profession .There is no likelihood of absconsion leaving his family, home and profession. No criminal antecedent is reported against the applicant. There is no likelihood of tampering with the evidence by the applicant as both the parties
