Shri Amrendra Nath Tripathi, learned counsel for the respondent No.2 submits that order dated 25.01.2019 passed by the writ Court in Writ Petition No.1776 (S/S) of 2019 could not be complied with and proceeding of contempt application is going on, therefore, it was decided by the Committee to forward the salary bill of the applicant, accordingly and also requested for deferring the contempt proceedings. As it is undisputed fact that the order dated 25.01.2019 was not complied with by the respondent No.2, therefore, request for deferring the contempt proceeding is hereby rejected. Vide order dated 21.09.2022, this Court after hearing the learned counsel for the parties, including Shri R.K. Chaudhary, learned counsel appearing for respondent no. 2, found that the interim order dated 25.01.2019 passed by the writ Court in Writ Petition (S/S) No. 1776 of 2019 is being wilfully disobeyed by respondent no. 2, fixed the matter for 26.09.2022 for framing of charges against respondent no. 2-Surendra Vikram Singh. On 26.09.2022, after hearing the learned counsel for the parties, this Court while framing charges against respondent no. 2, granted him time to file explanation and posted the matter for 10.10.2022.
