According to Article 63, there shall be a Vice-President of India. He is the ex-officio Chairman of the Council of States (the Rajya Sabha). The Vice-President is not a member of the Rajya Sabha, and hence he has no right to vote. Being the Vice-President of India, he is not entitled for any salary, but he is entitled to the salary and allowance payable to the Chairman of the Council of States. When he acts as the President or discharges the functions of the President, he shall not perform the duties of the office of the Chairman of the Council of the States and shall not be entitled to receive the salary. No person shall be eligible to be elected as the Vice-President unless: he is a citizen of India, he has completed the age of 35 years, he is qualified for election as a members of Council of States. A person holding any office of profit under the Government shall not be eligible for election as the Vice-President. The Vice-President is elected by an Electoral College consisting of the members of both the Houses of Parliament in accordance by means of a single transferable vote. The election to the vacancy of the office of the Vice-President is completed before the expiry of his term. An election to the vacancy of the office of the Vice-President occurring due to death, resignation or removal shall be held as soon as possible after the occurrence of the vacancy, and the person elected to fill the vacancy shall be entitled to hold office for the full term of five years from the date on which he enters his office. There is no mandatory provision, like in case of the President, to hold the election within the six months. Krishna Kant was the first Vice-President of India to die in office. When two Presidents, Dr. Zakir Hussain and Fakruddin Ali Ahmed, died in office, the then  respective Vice-President, V V Giri and B D Jatti acted as President. The Vice-President Dr. S Radhakrishanan discharged the functions of the President in June 1960, when the then President  Dr Rajendra Prasad  was on a 15 days tour to  the USSR and in July 1961, when Dr Rajendra Prasad was very ill.  If the offices of both the President and Vice-President fall vacant by reason of death, resignation, removal etc, the Chief Justice of India or in his absence  the senior most judge of the Supreme Court of India acts as President.
